Should you use a traditional jury consultant?
Many jury consultants rely on attitude surveys and demographic profiling. While these tools have value, they cannot fully capture how real people react when they actually hear the facts, see the evidence, and discuss the case as a group. Jury consultants must select or profile potential jurors without those individuals having any specific information about the case, the evidence, or the arguments — making it difficult to accurately predict how they will respond once they are presented with the real facts during trial.
Many jury consultants are also unable to gauge the emotional impact of specific evidence, witness testimony, or arguments on real people. Surveys and demographic profiles simply cannot replicate how jurors will actually feel when they hear a compelling (or damaging) story, see a powerful exhibit, or watch a witness testify. Focus groups, by contrast, are specifically designed to capture these emotional reactions in real time as participants hear the facts, discuss them as a group, and reveal what moves them, angers them, confuses them, or resonates with their sense of justice.
